Belgian Court Sides With eBay Over L'Oreal Complaint

Brussels, Belgium (AHN) - eBay won another counterfeiting lawsuit, this time in a Belgian court ruling that the Internet auction giant had no "general monitoring obligation." French cosmetic company L'Oreal said it will appeal the decision.

The court's decision is the second stating eBay is not legally required to check that items sold on the site are not counterfeits of famous brands. In July, a New York court ruled against Tiffany, saying eBay was not required to police items offered for auction.

In the latest ruling, the Belgian court said eBay acted correctly by removing L'Oreal items after receiving a letter from the French company. In addition, the court ruled L'Oreal must pay $22,400 in court costs.
