According to U.S. attorney in Manhattan Michael J. Garcia, there were no evidence that Spitzer used public money or campaign funds to pay prostitutes of the Emperor's Club V.I.P., which charges as much as $5,500 an hour for its service, and in traveling from state to state with prostitutes. Filing criminal charges against Spitzer also will not benefit the public, Garcia said.
Spitzer, who resigned in March after he was exposed as Client 9 who rendezvous with the club's prostitute in Washington on the night before Valentine's day, welcomed the decision in a statement released to the media.
"I appreciate the impartiality and thoroughness of the investigation by the U.S. attorney's office, and I acknowledge and accept responsibility for the conduct it disclosed," he said in the statement.
