Michael Lohan Spared From Jail Following Harassment Suit

Topics: EntertainmentSuffolk County, NY (CNS) - Lindsay Lohan's equally controversial father has been spared from jail. A Long Island judge ruled that Michael Lohan would not be prosecuted for misdemeanor aggravated harassment if he can behave for a year.

Michael's charge stems from an incident in April when he allegedly called his 34-year-old girlfriend Erin Mueller and threatened to kill himself and her if she left him.
A spokeswoman for the Suffolk County District Attorney told E! News, "If he does do something, our office has the option of petitioning the court to place the case back on the calendar."
"It's like being on parole... You have to be good, otherwise you're going to get it back."
Michael has until June 3, 2010 to be "good."
His attorney said his client is "obviously pleased" that the charges were dismissed.
He told TMZ, "The dismissal is a reflection of how silly and meritless the allegations were. With this matter behind him, Mr. Lohan can refocus on his numerous charitable and humanitarian projects."
Mr. Lohan previously served two years in jail for attempted assault and driving while intoxicated.
