The British Columbia Supreme Court favored Telus in its decision filed under the Competition Act. The court heard the lawsuit on Friday and Justice Christopher Grauer issued a ruling Tuesday.
The Supreme Court said Rogers no longer has speed advantage over Telus after the latter upgraded this month by tapping high-speed packed access network technology. With the decision, Telus could force Rogers to remove its advertisements using the claim found from billboard to benches in bus stops.
Rogers earlier dropped its fastest network claim after Telus and Bell Canada upgraded.
